  • More about European Cross-Border Insolvency Law

The first edition of this textbook was published in 2016, but since then, European cross-border insolvency law has changed significantly. The second edition maintains its original purpose of providing readers with a user-friendly framework but includes new bibliographical references, observations, and reorganizations to analyze the impact of the new events and discuss the most recent interpretations of judges and scholars.

Format: Hardback
Length: 384 pages
Publication date: 12 August 2022
Publisher: Oxford University Press

The first edition of this textbook was published in 2016, but since then, the legal and factual scenario of European cross-border insolvency law has undergone a significant transformation. In particular, three main events have occurred. Firstly, the prescriptions of Regulation (EU) 2015/848 (Recast) have come into force, marking a pivotal moment in the regulation of cross-border insolvency proceedings. Secondly, the UK has left the European Union, although this move has not entirely diminished the significance of the regulation for the UK. Thirdly, the European Union has enacted Directive (EU) 2019/1023 on preventive restructuring and insolvency, further shaping the landscape of European insolvency law.

Moreover, since 2016, the Court of Justice of the European Union (CJEU) has delivered significant new judgments, albeit regarding the Regulation (EU) 1346/2000. National courts have also begun applying the prescriptions of Regulation (EU) 2015/848, and scholars have produced numerous papers and commentaries on the regulation. Additionally, the United Nations Commission on International Trade Law (UNCITRAL) has issued relevant new documents, including the 2018 Model Law on Recognition and Enforcement of Insolvency-Related Judgments and the 2019 Model Law on Enterprise Group Insolvency.

The second edition of this textbook maintains its original purpose of providing readers with a user-friendly framework to understand the rationale of Regulation (EU) 2015/848 and ensure consistency in its application. To achieve this, each chapter has been thoroughly revised and updated. New bibliographical references have been added, accompanied by further observations and, in some cases, even reorganizations.

In conclusion, the evolution of European cross-border insolvency law has been marked by significant developments since the first edition of this textbook was published in 2016. The implementation of Regulation (EU) 2015/848, the UK's departure from the European Union, and the enactment of Directive (EU) 2019/1023 have all played pivotal roles in shaping the current legal landscape. The second edition of this textbook aims to provide readers with a comprehensive and up-to-date understanding of the regulation, allowing them to apply its principles effectively and contribute to the development of this dynamic field.
