This comprehensive book delves into the ethical dimensions of in-house practice, offering a thorough examination of how legal risk is defined and managed by in-house lawyers and other professionals. The increasing prominence and significance of the role of General Counsel have coincided with the growing importance of legal risk as a phenomenon. While in-house lawyers are often encouraged to be more commercial, proactive, and strategic, they are increasingly being held accountable for their roles in organizational scandals. This book raises the crucial question: to what extent does going beyond the traditional role of a lawyer involve embracing greater ethical principles? To answer this, the book draws upon three key empirical research sources: two rounds of in-depth interviews with senior in-house lawyers and senior compliance staff, as well as an extensive survey of in-house lawyers. Through this evidence, the authors explore how ideas about in-house roles shape professional logics, the extent to which professional notions such as independence play a role in these logics, and the management or absence of ethical infrastructure in in-house practice. The book concludes with a thought-provoking discussion on whether and how in-house lawyers and their regulators should prioritize professionalism and professional ethicality.
