  • More about Irreconcilable Founders: Spencer Roane, John Marshall, and the Nature of America's Constitutional Republic

Spencer Roane was an influential jurist and political thinker who was the philosophical leader of the Jeffersonians, architect of states' rights doctrine, legislator, essayist, and justice of the Virginia Supreme Court. He was the son-in-law of Henry and a confidant of Jefferson. His opinions established judicial review of legislative acts ten years before Supreme Court Chief Justice Marshall did the same in Marbury v. Madison. He also brought down Virginia's state-sponsored church. His descent into historical twilight is curious given his fierce criticism of Marshall's nationalistic decisions. David Johnson's Irreconcilable Founders is the first-ever biography of this highly influential but largely forgotten justice and political theorist, using Roane's long-lasting conflict with Marshall as ballast.

The early history of the United States is closely intertwined with the story of Virginia, and a prominent figure in this narrative is Spencer Roane (1762-1822). Roane, a fellow Virginian, was a jurist, political thinker, legislator, essayist, and justice of the Virginia Supreme Court for twenty-seven years. Despite his significant contributions, Roane is often overlooked in accounts of early America. This lack of interest is remarkable, considering that Roane was the philosophical leader of the Jeffersonians, architect of states' rights doctrine, a legislator, and a justice of the Virginia Supreme Court.

Roane's influence extended beyond Virginia. He was the son-in-law of Henry, a confidant of Jefferson, founder of the influential Richmond Enquirer, and head of the Richmond Junto. Roane's opinions, particularly in the case of Marbury v. Madison, established judicial review of legislative acts ten years before Supreme Court Chief Justice Marshall did the same. Roane also played a crucial role in bringing down Virginia's state-sponsored church, a move that challenged the religious establishment of the time.

However, Roane's descent into historical twilight is even more intriguing given his fierce criticism of Marshall's nationalistic decisions. In his book, Irreconcilable Founders, David Johnson uses Roane's long-lasting conflict with Marshall as the basis for the first-ever biography of this highly influential but largely forgotten justice and political theorist. Historians have tended to dismiss Roane or cast him as an annoying gadfly, partly due to the dominance of Marshall's legal opinions and the relative inaccessibility of Roane's writings.

Roane's legacy is significant, and his contributions to the development of American law and politics should not be overlooked. His clash with Marshall, which was a major debate in federalism, provides a valuable perspective on the early years of the United States. By examining Roane's life and work, we can better understand the complex and evolving nature of American society and politics during the founding era.
