  • More about Justice for Some: Law and the Question of Palestine

Justice in the Question of Palestine is often framed as a question of law, but none of the Israel-Palestinian conflict's most vexing challenges have been resolved by judicial intervention. Noura Erakat's book "Justice for Some" offers a new approach to understanding the Palestinian struggle for freedom, showing how the strategic deployment of law has shaped current conditions. She argues that international law can serve the cause of freedom when mobilized in support of a political movement.

Justice in the Question of Palestine is frequently presented as a legal matter. However, none of the most challenging issues in the Israel-Palestinian conflict have been resolved through judicial intervention. Occupation law has failed to curb Israel's settlement enterprise. Laws of war have authorized killing and destruction during Israel's military offensives in the Gaza Strip. The two-state solution proposed by the Oslo Accord is now a dead letter.

Justice for Some offers a fresh perspective on the Palestinian struggle for freedom, examining the power and control of international law. Noura Erakat highlights key junctures, from the Balfour Declaration in 1917 to the ongoing wars in Gaza, to demonstrate how the strategic deployment of law has shaped current conditions. Throughout the past century, international law has served Israel's interests more than the Palestinians. Erakat argues, however, that this outcome was not inevitable.

Law is inherently political, and its interpretation and application depend on the political intervention of states and individuals. Within the legal framework, change is possible. International law can be a powerful tool for promoting freedom when it is mobilized in support of a political movement. Justice for Some presents the promise and risks of international law and calls for renewed action and attention to the Question of Palestine.
