  • More about Private International Law in English Courts 2e

The first edition of this book offered a restatement of European and English Private International Law as it was applied in the English courts. The decision of the UK to withdraw from the EU and the EU to bar the UK from entry to the Lugano Convention has meant that the broad structure of the book needed fundamental change to reflect the new law. This new edition endeavours to describe and explain how the law works and sometimes does not work, providing critical analysis and guidance relevant both before and during litigation. It offers an approach to private international law as it stands six years after the national referendum, in much the same way as the previous edition did with the hybrid system of English and European law before that event.

Format: Hardback

The first edition of this book presented a comprehensive overview of European and English Private International Law as it was applied in the English courts. However, significant developments have occurred since then, particularly with the United Kingdom's decision to withdraw from the European Union (EU) and the EU's decision to exclude the UK from the Lugano Convention. These events have necessitated a fundamental reevaluation of the book's structure to accurately reflect the new, yet somewhat archaic, legal landscape.

As we navigate through the intricate consequences of this separation, it becomes evident that the law has lost some of the coherence it had previously developed. Whether the rough edges of the new system can be smoothed and how this can be achieved remains a matter of speculation. However, this new edition aims to provide a comprehensive description and explanation of how the system functions (and occasionally fails). The book offers valuable insights and critical analysis, relevant not only during litigation but also for those seeking to understand the intricacies of private international law in the post-Brexit era.

Written by an academic and practicing barrister with over 40 years of experience, this book offers a unique perspective on private international law as it stands six years after the national referendum. It follows a similar approach as its predecessor, providing a comprehensive overview of the hybrid system of English and European law prior to Brexit. Only by gaining a deep understanding of the law's state, structure, and coherence before Brexit can we truly comprehend the impact of the new legal reality.

In conclusion, this new edition of the book is a valuable resource for anyone interested in private international law, particularly in the context of the post-Brexit era. It offers a comprehensive and insightful analysis of the current legal landscape, providing critical guidance and analysis for practitioners, academics, and policymakers alike. As the legal landscape continues to evolve, this book will undoubtedly remain a staple in the field.
