  • More about Transitional Justice in Peacebuilding: Actor-Contingent and Malleable Justice

This book examines the role of actors in determining transitional justice in peacebuilding contexts. It proposes a novel framework for analyzing and approaching transitional justice that disaggregates three broad sets of actors operating at different levels. It argues that transitional justice must be conceived of as actor-contingent and malleable due to the significance of agency and (inter)actions of key categories of actors throughout the peacebuilding transition.

In recent years, the concept of transitional justice has gained significant prominence in the realm of peacebuilding. Transitional justice mechanisms and processes have been introduced to diverse contexts, widely recognized as essential components in the toolkit of peacebuilding. However, there has been a growing perception that transitional justice is predominantly imposed by neo-imperial actors who disregard the needs and cultures of local populations. This book aims to challenge this notion by examining the role of actors in determining transitional justice in peacebuilding contexts.

Through an empirical analysis of three sites of peacebuilding that have undergone extensive international involvement: Kosovo, East Timor, and Afghanistan, the book proposes a novel framework for analyzing and approaching transitional justice in peacebuilding. This framework distinguishes three broad sets of actors: external actors (international and regional levels), transitional justice promoters (local, national, international, and transnational levels), and transitional regimes (national and local levels). The book argues that transitional justice in peacebuilding must be conceived as actor-contingent and malleable, recognizing the significant role of agency and (inter)actions of key categories of actors throughout the peacebuilding transition.

This book will appeal to students and practitioners of transitional justice, peacebuilding, law, and International Relations. It offers valuable insights into the complex dynamics of transitional justice and its implications for promoting peace, justice, and sustainable development in conflict-ridden societies. By exploring the roles of various actors and their interactions, the book provides a comprehensive understanding of the factors that shape transitional justice processes and outcomes.
